These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as do the Company, to submit to the exclusive jurisdiction of the English Courts.
These terms constitute the entire agreement between the Company and the Client in relation to the Company accepting a Customer’s order. The Customer acknowledges that the Customer is not relying on any statement made by the Company or any of the Company’s representatives with regard to the offering other than those expressly set out in these conditions.
The agreement to which these conditions apply is not intended for the benefit of any third party and shall not be exercised by any other person under the Contract (Rights of Third Parties) Act 1999 or otherwise.

You agree to use the content of this website only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of the website.
Changes to website and conditions
My-gene-diet will endeavour to keep the content of the website accurate and complete but you should be aware and accept that such information may become out of date over time. The website, information and linked contained therein are provided for your use without express or implied warranty of any kind.
We reserve the right to make changes to the content and layout of the website at any time and shall not be liable to you for any direct or indirect loss, damage or costs resulting there from.
As and when appropriately necessary, My-gene-diet will make changes to these Conditions and your continued use of the website. Following such changes will be deemed to imply your acceptance of the Conditions prevailing at that time.
Payment of goods
Payments must be made on receipt of an order. Online payments are accepted via a secure Payment Gateway operated by SagePay. Your credit card details are not collected by the My-gene-diet web site and My-gene-diet will never have access to your credit card details. Payment may be made using Visa, Visa Debit, MasterCard, American Express (AMEX) or PayPal.
We aim to despatch all orders within 3 working days. Please allow a minimum of 5-7 working days for delivery to Europe and a minimum of 10 working days to the Rest of the World.
For the My-gene-diet test and email report on the test results and the ensuing advice will be sent to you be email within three weeks of us receiving the mouth swab and customer questionnaire back from you.
For all orders made from the UK or European Union countries 20% VAT is included in your order. All orders from other countries are VAT free.
At all times Natures Remedies remains the owner of all information, data, text, graphics, links or computer code published on, contained or available on the website. Use of this material including the production, storage, modification, distribution or republication without the prior written consent of Natures Remedies, or where applicable, the respective copyright owner(s) is prohibited. The names and logos of Natures Remedies and all related products and service names, design marks and slogans are the trade names, service marks or trademarks of Natures Remedies and also may not be used without the prior consent of Natures Remedies.
The Company will not be held responsible for any delay or failure to comply with the Company’s obligations under these conditions if the delay or failure arises from any cause which is beyond the reasonable control of the Company.
You agree to indemnify and hold My-gene-diet, its subsidiary companies and employees harmless from and against all and any liabilities, damages and costs in respect of any claims or actions brought as a result of any breach by you of these Conditions, or any liabilities arising from your use of the website.
Data protection policy
In order to operate efficiently, we must collect information about people with whom we work. These may include members of the public, current, past and prospective employees, funded bodies and suppliers. In addition we may be required by law to collect and use information in order to comply with the requirements of central government.

We are registered with the Information Commissioner to process personal data. We are named as a data controller under the register kept by the Information Commissioner in accordance with section 19 of the Act.
Information covered by the Act
The Act uses the term 'personal data'. For information held by My-gene-diet, personal data essentially means any recorded information held by us and from which a living individual can be identified. It will include a variety of information including names, addresses, telephone numbers, photographs of people and other personal details. It will include any expression of opinion about a living individual or any indication of our intentions about that individual.

Our commitment to data protection

We have appointed a head of information compliance to lead on data protection for My-gene-diet. This person is responsible for ensuring that the policy is effectively implemented.

If you have any specific delivery instructions (e.g.: "boxes only, no pallets") please let us know and we will do all we can to accommodate them. For all areas other than mainland UK please call for confirmation of price.
We will liaise with your nominated freight agent to ensure that your order is dispatched in a timely and satisfactory manner. We can dispatch using our own freight agent whereby costs will be advised and agreed before dispatch.
We will endeavour to meet any request for a specified time of delivery, however; time of delivery will not be of the essence of the contract unless expressly stipulated in writing. Failure to deliver by a quoted or specified time shall not be a ground for cancellation or refusal to take delivery.
It is important to check all deliveries and inspect for damage before signing for them. Damage or shortages must be noted on Carriers Delivery Sheet immediately and notice in writing given to the Company within 3 days of receipt of goods. Remember to keep the original delivery box for inspection by the courier - all carriers require you to inform us about damaged material or box shortages.
We'll despatch your order within 24 hours if we have the products you have selected in stock, which we normally do. If a product is out of stock we will contact you to discuss the likely delivery time or an alternative product.
Purchases for delivery in mainland UK are despatched by 'next day' post or courier and will normally be delivered to you the day after your order is placed. Our aim is to dispatch orders received by 12 noon on the same day if required. Orders received after this time will normally be dispatched the next working day. If you need items before a certain time i.e. before 9am, 10.30 or midday please call and we will confirm a price and availability.
For other destinations, times and prices vary please call for confirmation.
When your order is despatched we will advise by telephone or email.
All goods are carefully packed and shipped as soon as they are available to fulfil your order.
We reserve the right to withdraw any product or offer from the website at our discretion, including the refusal of any transaction attributed to those products / offers.
Credit Card Security
Payments made online are taken via SagePay. My-gene-diet will never see your bank or credit card details when you pay online.
If not paying online we will contact you to arrange payment and delivery. We do take credit card payments over the phone.
The Information We Need and How We Use It
We are committed to protecting your privacy and we comply with the Data Protection laws applicable to business in the UK. We do not disclose our customer's personal information to third parties. We do not send unsolicited e-mail's to our customers or potential customers. We only use the information we collect about you to process orders and to provide a more personalised shopping experience. We continually monitor web statistics including site usage and search engine patterns to help us develop the design and layout of our web site. This in no way affects our customer's privacy.
When you order from us or make an enquiry, we will require your name, address, e-mail address, phone number and other similar information to enable us to process your request, notify you of acceptance of orders and deliver the goods ordered.
We may, unless you tell us not to, pass this information to our couriers or other agents in case they need to contact you to arrange the processing or delivery of your order.
